Delegate Dillon and Linville moved to amend the bill by striking out the title and substituting therefor a new title, to read as follows:

A BILL to amend and reenact §8-19-17, §8-20-16, §16-13-22a, and §16-13A-24 of the Code of West Virginia, 1931, as amended; and to amend said Code by adding thereto four new sections, designated §8-19-1a, §8-20-1d, §16-13-18b, and 16-13A-1d; all relating to establishing the Water And Wastewater Systems Reform Act; relating generally to water and wastewater systems; requiring quarterly reporting by water and wastewater utilities that are political subdivisions of the state to their governing bodies; requiring annual continuing education for board members and senior management; requiring municipalities to determine the cost of adding potential customers to water service from the municipality; requiring municipalities to apply through the West Virginia Infrastructure and Jobs Development Council for available funding; requiring municipalities to extend service to potential customers who have paid required tap fees if a grant or grants are awarded to cover the fees for the service extension; requiring public water systems implement the State Auditor’s West Virginia Checkbook fiscal reporting system; mandating that when  five or more formal complaints are filed against a system with the Public Service Commission in one quarter, the Public Service Commission may, without opening a formal investigation, order a thorough review of financial and operational practices to be conducted by an independent non-governmental organization with expertise in public water systems; and providing for funding and reimbursement of application costs to potential customers.
